Witness 1: Tanvir Hassan Zoha
Evidence given by Tanvir Hassan Zoha.
My name is Tanvir Hassan Zoha. My current age is 41 years. My address is [redacted] Dhaka.
I am a Prosecutor of the International Crimes Tribunal Bangladesh and simultaneously a Special Investigating Officer in this case.
On December 29, 2024, at 16:00 hours, on the 10th floor of the BTRC building under Sher-e-Bangla Nagar Police Station, upon presentation by Mahrin Ahsan, Deputy Director of the Spectrum Department, BTRC, I seized an iPhone 14 Pro mobile phone (IMEI 1: 354 001271404501; IMEI 2: 354001211390130) and the used SIM number 01716 360521 in the presence of witnesses. This is that seizure list, Exhibit 1. My signature therein is Exhibit 1/1. I handed over the seized mobile phone to the then-Investigating Officer (IO) of this case, Monirul Islam.
In accordance with a requisition letter dated November 12, 2025, from the subsequent Investigating Officer, Mr. Md. Jane Alam Khan, I handed over the following documents on November 27, 2025:

- Certified photocopies of the report sent by Robi Axiata PLC (23 pages, pages 179 to 201).
- A one-page copy of the Voice CD belonging to Zunaid Ahmed Palak, Mohammad Anisul Huq, and Salman F. Rahman (Page 176).
- Two-page copies of the seizure lists for ICTBT Misc. Case Nos. 2/2024, 3/2024, and 4/2024, seized from the NTMC on January 29, 2025, at 15:53 hours (Pages 177 to 178).
- Three-page print copies of the CDR for Salman Fazolur Rahman’s mobile number 01711 114456, dated July 23, 2024 (Pages 202 to 204).
- A one-page print copy of the CDR for Colonel Razib Ahmed’s mobile number 01730307898, dated August 5, 2024 (Page 205).
This is that forwarding letter, Exhibit 2 (Page 175 of the Seizure List and Documentary Evidence Volume). My signature on the forwarding letter is Exhibit 2/1.
This concludes my deposition.
Cross Examination on behalf of present accuseed Zunaid Ahmed Palak
On December 29, 2024, when I prepared the seizure list, I was appointed as an Investigating Officer. It is true that on the seizure list, under my signature as the preparer, I am not mentioned as the “Handing-over Officer.”
The handwriting on the seizure list is not my own. It is true that it is not mentioned in the seizure list whose handwriting it is. I have disclosed the names of the persons who wrote it to the Investigating Officers of this case, Monirul Islam and Jane Alam Khan.
I did not mention in the seizure list who the owner of the seized iPhone is. I have verified the ownership. I came to know that Mahrin Ahsan is the owner. However, I cannot say in whose name it was registered. I did not mention in the seizure list that Mahrin Ahsan is the owner. Prior to handing over this seizure list, I maintained a supplementary case diary. I have provided the supplementary case diary to the Investigating Officer.
I did not send the evidence described in this seizure list to the forensic laboratory for examination. I signed in Bengali on the seizure list described on page 154. Yes, I signed in English on the forwarding letter described on page 175. I did not mention in the forwarding letter the date, time, or the persons involved in the collection of evidence items 1 to 5. However, it is in the seizure list. It is not mentioned in this seizure list on which date, at what time, or from whom these items were collected. However, pursuant to the Tribunal’s order, I seized them upon presentation by witness Md. Rifat, Instructor and Government Engineer, NTMC. He collected the data from the NTMC server, recorded it onto a DVD, and handed it over to me.
It is not true that nothing was given to me by recording from the NTMC server.
Prior to being appointed as a Prosecutor and Special Investigating Officer at the ICTBD, I was working as an instructor in a project under the Information and Communication Technology (ICT) Division of the Government.
I did not directly seize any audio, video, or mobile phone regarding the voice of Zunaid Ahmed Palak. However, I seized the call records of Anisul Huq and Salman F. Rahman. Among their conversations, Zunaid Ahmed Palak’s voice exists as the “B-Party.” The Investigating Officer has arranged for the forensic examination of all voices, including that of Zunaid Ahmed Palak.
I was never employed at the DGFI or SB.

There is no signature of Mahrin Ahsan on the seizure list. At the time of preparing the seizure list, I took assistance from the Sher-e-Bangla Nagar Police. The second witness of the seizure list of Sher-e-Bangla Nagar Police Station is an Office Assistant of the Spectrum Department at the BTRC building. Yes, there were other superior officers there. I made one of them a witness. The date is not mentioned below the signatures of the witnesses and my signature in the seizure list. However, the date and place of seizure are mentioned at the beginning of the seizure list.
It is not true that this seizure list is not a seizure list related to this case.
There are descriptions regarding Sajeeb Ahmed Wazed Joy between pages 179 to 201 of the Seizure List and Documentary Evidence Volume. Certain matters are mentioned in the said report; the call records of Sajeeb Ahmed Wazed Joy are not mentioned, but it is a report by Robi Axiata Limited PLC regarding the internet shutdown.
The handwriting on the seizure list in the report on page 177 of the volume seized on January 29, 2025, is not mine.
