My name is Kabir Hossain. My current age is 54 years. My address is: [redacted] Dhaka.
I am a businessman. I am the father of the six-year-old child martyr, Jabir Ibrahim.
On 05-08-2024, at approximately 2:00 PM, upon learning that Sheikh Hasina had fled, I took my two sons, a nephew, and my wife to participate in a victory procession opposite the Uttara Scholastica School. There, I climbed onto a footbridge under construction along with my two sons and nephew. My wife remained downstairs. We were taking photos and recording videos. At around 4:30 PM, a group of 15 to 20 individuals wearing helmets and sando vests came advancing toward us from the direction of Uttara East Police Station, firing live ammunition and throwing sound grenades. People began running frantically in all directions.
I quickly came down with my two sons and nephew. Holding my son Jabir Ibrahim’s hand, I was running eastward toward my house. As soon as we reached in front of the APBn (Armed Police Battalion) Headquarters gate, my son Jabir Ibrahim screamed, “Ah!”. I noticed that my son had been shot in the thigh, just below his abdomen, and blood was streaming down his leg. He was unable to walk. I took him in my arms and boarded a motorcycle. At that moment, I saw several other bullet-ridden individuals lying on the ground on the opposite side of the APBn Headquarters gate.
I rushed my son to Kuwait Maitree Hospital. My son’s condition became critical. Since that hospital did not have a pediatric ICU facility, I took him to Crescent Hospital at around 5:00/5:30 PM. As the ICU was occupied there as well, I took him to Dhaka Specialized Hospital in Uttara Sector 12. There, the attending doctors examined him and declared my son dead. I took my son’s body and buried him at the Uttara Sector 4 graveyard.
I hold the Prime Minister of the then government Sheikh Hasina, her son Joy, Asaduzzaman Khan Kamal, Zunaid Ahmed Palak, and all other members of the cabinet responsible for the death of my son by gunfire. This is because the shooting was carried out under their direct orders. I have heard an audio recording of Sheikh Hasina, in which she gave instructions to use lethal weapons. Personnel from the APBn, the Police, and activists of the Awami League, Chhatra League, and Jubo League were present at the scene. I demand the maximum legal punishment for all those mentioned above, including whoever among them is found responsible.
The investigating officer has interrogated me. This is my statement.
Cross-examination on behalf of the accused Zunaid Ahmed Palak, who is present in court:
The investigating officer interrogated me in the month of November 2025. The date might be the 25th or 26th.
Defence: When were you examined by the Investigating Officer?
PW: I was examined by the Investigating Officer in November 2025, possibly on 25 or 26 November.
Defence: Did you obtain the death certificate of your son from Dhaka Specialized Hospital and submit it to the Investigating Officer?
PW: Yes, I obtained the death certificate of my son from Dhaka Specialized Hospital and submitted it to the Investigating Officer.
Defence: Was any post-mortem examination conducted on your son, Jaber Ibrahim?
PW: No, no post-mortem examination was conducted on my son, Jaber Ibrahim.
Defence: Did you hand over the T-shirt worn by your son at the time of the incident to the Investigating Officer?
PW: Yes, I handed over the T-shirt worn by my son at the time of the incident to the
Investigating Officer.
Defence: Did you file any case regarding the killing of your son Jaber Ibrahim? If so, can you state the case number?
PW: Yes, I filed a case regarding the killing of my son Jaber Ibrahim. I do not remember the case
number.
Defence: When did you file the said case?
PW: I filed the case before the Court in September 2024.
Defence: Did you submit all relevant documents of that case to the Investigating Officer?
PW: Yes, I submitted all documents relating to the case that were in my possession to the Investigating Officer.
Defence: Did the Investigating Officer take your signature during that time?
PW: I do not recall whether my signature was taken by the Investigating Officer.
Defence: How many persons were named as accused in that case?
PW: Eighteen persons were named as accused in that case.
Defence: Did the Investigating Officer of your case examine you(the case filed in September 2024)?
PW: Yes, I was examined by the Investigating Officer of my case.
Defence: Is the said case still pending?
PW: Yes, the case is still pending.
Defence (Suggestion): Junaid Ahmed Palak is not responsible for the gunshot injury of your son.
PW: It is not true that Junaid Ahmed Palak is not responsible for the gunshot injury of my son.
Cross-examination on behalf of the absconding accused Sajeeb Ahmed Wazed Joy
Defence: What is the distance between your residence and the APBN Headquarters Gate?
PW: The distance is approximately 800 yards from my residence at 92 West Mollartek to the APBN Headquarters Gate.
Defence: On which side is your house situated on the railway line and is it your own house?
PW: Yes. My house is situated on the eastern side of the railway line, and it is my own residence.
Defence: Under which police station does your residence fall?
PW: It falls under Dakshinkhan Police Station.
Defence: What is the approximate distance between APBN Headquarters Gate and Uttara Police Station?
PW: It is approximately 1,000 to 1,500 yards distance between APBN Headquarters Gate and Uttara Police Station.
Defence: Was Uttara Police Station attacked on that day?
Prosecution: Objection. The witness is not competent to testify on this issue;
Tribunal: Objection sustained.This is already in judicial notice that police stations had been vandalized on that day.
Defence: Did you take any steps to arrange primary medical treatment for your injured son?
PW: Yes, I took steps to arrange primary medical treatment for my injured son.
Defence: What is the distance between Kuwait-Maitree Hospital and APBN Headquarters Gate?
PW: The rickshaw fare between Kuwait-Maitree Hospital and APBN Headquarters Gate was Tk. 40.
Defence: Was any doctor available in the emergency department of that hospital at the relevant time?
PW: Yes, the doctor was present. My son was bandaged, but the bleeding could not be stopped.
Defence: When did you reach Dhaka Specialized Hospital with your injured son?
PW: I reached Dhaka Specialized Hospital before Maghrib.
Defence: How was your son transported from one hospital to another?
PW: He was transported by ambulance.
Defence: Prior to medical examination, did you know the time of death?
PW: No, I did not know the time of death prior to the medical examination.
Defence (Suggestion): Your son died due to excessive bleeding and lack of proper medical treatment during transfer.
PW: It is true that my son died due to excessive bleeding and lack of proper medical treatment during transfer.
Defence: Was any inquest held over the body of your son?
PW: No inquest was held, as no police personnel were present at the relevant time.
Defence: When did you bury your son?
PW: I buried my son at 1:00 a.m. the following night.
Defence: Did you obtain permission to bury your son?
Prosecution: Objection. At that time there was no situation to take permission for that.
Defence: No such body can be buried without the permission of the Magistrate as no inquest was
held.
Tribunal: Objection sustained. At that time there was no magistrate on service and in the crime
against humanity situation no inquest was required.
Defence: Was Sajeeb Ahmed Wazed Joy present in Bangladesh on 05.08.2024?
PW: He was outside the country on that date. Subsequently, I learned through social media that instructions regarding the use of firearms were issued involving Sheikh Hasina and Sajeeb Ahmed Wazed Joy.
Defence (Suggestion): Sajeeb Ahmed Wazed Joy was not involved in any plan regarding the use of firearms.
PW: It is not true that Sajeeb Ahmed Wazed Joy was not involved in any such plan.
Tribunal: No suggestion can be made out of cross examination.
Defence (Suggestion): At the time of the incident, Sheikh Hasina was not in power and Sajeeb Ahmed Wazed Joy was not serving as ICT Adviser.
PW: It is correct that Sheikh Hasina was not in power and Sajeeb Ahmed Wazed Joy was not serving as ICT Adviser; however, their instructions were in existence.
Defence (Suggestion): You have concealed the true facts and given false testimony.
PW: It is not true that I have concealed the true facts or given false testimony.
