Summing Up by the Prosecution

Case Overview:

Three specific charges have been framed against five accused individuals. Among them, Chanchal Chandra Sarkar, the former Assistant Sub-Inspector (ASI) of Rampura Police Station, is currently in custody. The remaining accused, including Habibur Rahman, the former Commissioner of Dhaka Metropolitan Police (DMP), are currently absconding. The formal charges were submitted by the Chief Prosecutor on July 7, 2025, following a year-long investigation into the events at Rampura Police Station. The prosecution has presented 14 witnesses, including the Investigating Officer (IO), to substantiate the killings and injuries.

Specific Charges

Charge 1:

The Killing of Nadim Nijam- On July 19, 2024, Mohammad Nadim Nijam was shot and killed by police while exiting a mosque in the Banasree area near Rampura.

Charge 2:

The attack on Amir Hossain – Amir Hossain was shot while holding onto a pillar/ledge of a building near Rampura Police Station. The shooting was carried out by police personnel positioned nearby.

Charge 3:

The Killing of Maya Islam and Injury to Basit Khan Musa- Police fired from within the Rampura Police Station. A bullet struck the head of a young child, Basit Khan Musa. It passed through him, and hit his grandmother, Maya Islam, in the abdomen. Maya Islam subsequently succumbed to her injuries, while Musa was severely wounded.

Evidence and Documentation

    1. High-Level Instructions and Conspiracy

Seizure List (Page 13): A recorded phone conversation between Sheikh Fazle Noor Taposh and former Prime Minister Sheikh Hasina discusses the use of lethal weapons and drones to identify and “target” students.

Operational Evidence (Pages 7-8): Documentation shows drones were used for surveillance and helicopters were deployed. Instructions were reportedly issued by the Prime Minister’s Office directing the use of “lethal weapons.”

DMP Commissioner’s Directives (Page 38): Wireless records of former DMP Commissioner Habibur Rahman show he ordered the “maximum use of force.” While the verbal instruction was ostensibly to shoot below the waist to protect property, the actual wounds sustained by victims (head and chest) indicate a lethal intent.

    1. Forensic and Technical Verification

Voice Analysis: PW-12 (Rokonuzzaman) testified regarding the voice test of Habibur Rahman. The likelihood ratio was 9.96, confirming the voice in the wireless records belonged to the former Commissioner.

Video Authentication: Video footage of Amir Hossain being shot on the building ledge and the shooting of baby Musa were verified by digital forensics as genuine and not Artificial Intelligence-generated (PW-6 and PW-13).

United Nations & Human Rights Reports: A UN report (Page 86) and a Human Rights Watch report (Pages 114-118) authenticated images and documented the victims, including Nadim Nijam.

GD 426 (July 18, 2024): Records the deployment of “China Rifles.”

Rewards for Killings: Records from Rampura Police Station indicate that on the nights of July 17, 18, and 19, officers on duty were promised a reward of 1,000 BDT each. Subsequently, a collective reward of 100,000 BDT was provided to the station. Commissioner Habibur Rahman reportedly offered financial incentives for “head and chest shots.”

Witness Testimonies

For Nadim Nijam (Charge 1):

PW-3 (Tabassum Alam Niha, wife of the deceased) described recovering her husband’s body.

PW-5 (Golam Kibria Khan) and PW-8 provided eyewitness accounts of the firing near the Banasree mosque.

For Amir Hossain (Charge 2):

PW-1 (the victim/survivor) testified about how he was shot.

PW-11 (Dr. Jahid) testified regarding the medical treatment and the nature of the gunshot wounds.

For Maya Islam and Musa (Charge 3):

PW-2 (Mustafizur Rahman, father of Musa) described the harrowing moment the bullet struck his son and mother.

PW-4 (a local barber) witnessed the firing from the police station.

Prosecution: The prosecution has established through ocular, documentary, and forensic evidence that the accused acted with systematic lethal intent under superior orders. The defense has failed to provide any credible evidence to rebut these charges.

Given the gravity of these crimes against humanity and the cold-blooded nature of the killings of innocent civilians and children, the prosecution prays to this honorable Tribunal for the highest punishment (death penalty) for all the accused.

Prosecution: Honorable Tribunal, regarding the sentencing, the details have been provided on page 27 of the formal charge. The background of Chanchal Chandra Sarkar is on page 28. According to his educational qualifications, he joined the police force as a constable in 2005 and was later promoted to the rank of Assistant Sub-Inspector (ASI). Then, we have Sub-inspector Tarikul Islam Bhuiyan, who joined the police on June 14, 2021. He notably holds an MBA from Dhaka University.

Their educational backgrounds prove that they were fully aware of the consequences of their actions. They deserve the maximum penalty because they knew exactly what they were doing, yet they still committed these heinous acts. For these reasons, the prosecution seeks the highest punishment for the accused.

Tribunal: The Tribunal has set February 3rd, 2026, as the date for the defense to present their summing-up arguments.
