Testimony of Mohammad Kamrul Hasan

My name is Mohammad Kamrul Hasan. I am serving in the Bangladesh Police as an SI (Unarmed) in the Operations Division, Dhaka, as a wireless operator. I was holding the same position on 17/07/2024. On that day, my duty hours were from 9:00 a.m. to 2:00 p.m.

Between approximately 11:00 a.m. and 11:30 a.m., the then DMP Commissioner, Sir Habibur Rahman, whose call sign was “Victor Mike One,” issued instructions to use maximum force to suppress the student–public movement. He instructed firing at the protesters with Chinese rifles from a kneeling position.

As a message carrier, I transmitted this audio instruction to all concerned units of the DMP.

At this stage of testimony, the said message was played aloud before everyone present in the court.

In the audio, the voices of DMP Commissioner Mohammad Habibur Rahman Sir, myself, and several others can be heard. This is the pen drive containing the said audio, marked as Exhibit–1.

The investigating officer interrogated me. This is my testimony.

Cross-examination on behalf of accused Chanchal:

Question: Did you identify before the court that the voice on the pen drive was yours?(Here, prosecutor Gazi Tamim interrupts; however, the defense lawyer asks him not to do so.)
Answer: I did not identify my voice in the audio message that was played. It is not true that I did not tell the investigating officer that my voice was present in the audio clip.

Suggestion: You have given false testimony as tutored.
Answer: It is not true that I have given false testimony.

Cross-examination on behalf of accused Habibur Rahman, Mohammad Rashedul Islam, Mohammad Mashiur Rahman, and Tarikul Islam Bhuiya (State Defense):

Question: Did you submit any documentary evidence to the investigating officer?
Answer: I do not have any documentary proof with me to establish the position I was holding on 17 July 2024.

It is not true that I did not perform any duty at the stated place on the mentioned date.

It is not true that the audio clip submitted and played today was unclear.

Question: Instructions to take a kneeling position are given only in life-threatening situations.

Judge Md. Mohitul Hoque Anam Chawdhury: This is a question of law. This can’t be asked.
Answer: It is not true that the DMP Commissioner instructed taking a kneeling position for self-defense.

It is not true that I testified as taught by others.
